These Terms of Service govern your use of shopnextria.com and purchases made from Nextria. By using the site or placing an order, you agree to these terms to the extent permitted by applicable law.

Important: Nothing in these terms excludes, restricts or modifies any consumer right, guarantee, remedy or liability that cannot lawfully be excluded or limited.

1. Store operator and contact

Nextria is the trading name used by this store. Contact: contact@shopnextria.com. Business contact address currently listed for the store: Moneyguyneen, Kinnitty, County Offaly, R42 XT57, Ireland.

2. Eligibility and lawful use

You must have legal capacity to enter into a purchase contract in your jurisdiction. You may not use the site or products for unlawful purposes, interfere with the security or operation of the site, attempt unauthorised access, or violate the rights of others.

3. Product and website information

We aim to present product descriptions, images, pricing, availability and other information accurately. Colours and appearance can vary by screen and device. We may correct genuine errors or update information where permitted by law. Nothing in this section permits us to make false or misleading representations or to avoid mandatory consumer rights.

4. Orders and acceptance

Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or begin fulfilment, subject to applicable law. We may refuse or cancel an order for legitimate reasons such as suspected fraud, pricing or inventory errors, payment failure, legal restrictions or inability to deliver. If we cancel an order after payment has been taken, we will refund the amount due.

5. Prices, currencies, taxes and charges

Nextria currently offers free worldwide shipping, including Australia. Prices may be displayed in different currencies depending on the market or currency selected. The checkout shows the amount charged for the transaction before purchase.

Taxes, duties, import fees or customs/carrier charges may still apply where legally applicable. Any amounts we collect will be disclosed at checkout. Charges not collected by us may be payable by the recipient. This does not alter any obligation we have under mandatory consumer law.

6. Payment

Payments are processed through Shopify and/or authorised payment providers. You agree to provide accurate payment and billing information and to have authority to use the selected payment method.

7. Shipping and delivery

Shipping and delivery estimates are estimates rather than guarantees unless expressly stated otherwise. Every order includes tracking. Tracking information is sent to the email address provided with the order after dispatch. Delays caused by carriers, customs, severe weather or other events outside our reasonable control may affect delivery.

Risk of loss or damage passes at the point required by applicable law. Nothing in these terms transfers risk to a consumer earlier than mandatory law permits.

8. Returns, refunds and consumer rights

Our Refund & Return Policy explains our voluntary return arrangements. It does not replace mandatory consumer rights.

Australian customers: when we sell directly to consumers in Australia, applicable consumer guarantees under the Australian Consumer Law apply. These guarantees cannot be excluded by these terms or by a store policy. Depending on the circumstances, a failure to meet a consumer guarantee may give rise to repair, replacement, refund, cancellation, compensation or another remedy required by law.

9. Product use and safety

Products must be used only for their intended lawful purpose and in accordance with the instructions, warnings, age requirements and safety information supplied with the product or displayed on the relevant product page. You are responsible for complying with laws and restrictions that apply to possession or use in your location. Nothing in this section limits rights relating to unsafe, defective or non-compliant goods under applicable consumer law.

10. Accounts and information you provide

If you create an account or provide information to us, you are responsible for ensuring that the information is accurate and for keeping account credentials secure. Notify us if you believe your account has been compromised.

11. Intellectual property

The site and its original text, branding, graphics, layout and other protected materials are owned by or licensed to Nextria and are protected by applicable intellectual-property laws. You may use the site for personal, non-commercial shopping purposes. No rights are transferred except as expressly stated.

12. Reviews, feedback and user content

If you submit reviews, feedback, photographs or other content, you must have the right to provide it and it must not be unlawful, deceptive, infringing, abusive or harmful. Where you grant us permission to display submitted content, that permission is limited to uses reasonably connected with operating and promoting Nextria, subject to applicable law and any specific consent terms presented when content is submitted.

13. Third-party services and links

The store is hosted by Shopify and may use third-party payment, fulfilment, analytics or other services. Third-party websites and services may have their own terms and privacy practices. We are not responsible for third-party content that we do not control, subject always to liabilities that cannot lawfully be excluded.

14. Privacy

Our collection and handling of personal information is described in our Privacy Policy. Your use of the store is also subject to privacy rights that apply in your jurisdiction.

15. Availability and service changes

We may modify, suspend or discontinue website features, products or services where permitted by law. This does not affect rights relating to an order already accepted or any rights that cannot be excluded.

16. Disclaimer of implied terms

To the maximum extent permitted by law, terms or warranties that may legally be excluded are excluded. We do not exclude any statutory guarantee, warranty, condition, right or remedy that the law says cannot be excluded.

For Australian consumers, this includes the non-excludable consumer guarantees under the Australian Consumer Law.

17. Limitation of liability

To the maximum extent permitted by law, Nextria is not liable for indirect or consequential loss that is not reasonably foreseeable and for which liability may lawfully be excluded. This limitation does not apply where liability cannot lawfully be excluded or limited, including remedies available under applicable consumer law.

18. Indemnity

To the extent permitted by law, you are responsible for loss directly caused by your unlawful misuse of the site, infringement of another person's rights, or material breach of these terms. This clause does not require a consumer to indemnify Nextria for matters caused by Nextria or where such an indemnity would be unfair or unenforceable.

19. Severability

If a provision of these terms is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

20. No waiver

A failure to enforce a provision immediately does not waive a right to enforce it later.

21. Applicable law

These terms do not displace any mandatory law that applies to the transaction or to you as a consumer. Unless a valid separate agreement specifies otherwise, questions of applicable law and jurisdiction are determined by the rules that legally apply to the transaction. In particular, nothing in this section removes rights available to Australian consumers under the Australian Consumer Law where it applies.

22. Changes to these terms

We may update these terms from time to time. Changes apply prospectively unless applicable law requires otherwise. The “Last updated” date identifies the current version.
